Terms of Service

These Terms of Service (“Terms”) govern your use of the ProgressPilot mobile application (“the app”), operated as a sole proprietorship (toiminimi) based in Finland. By downloading, installing, or using ProgressPilot, you agree to these Terms.

1. Eligibility

You must be at least 16 years of age to create an account and use ProgressPilot. By using the app, you represent that you meet this requirement.

2. Description of Service

ProgressPilot is an AI-powered strength training coaching application for iOS. It provides personalized weekly training programs, daily session targets, performance scoring, progression advice, and related fitness tracking features. The app operates with a local-first architecture — your data is stored on your device and optionally synced via iCloud.

3. Account

You sign in using Apple Sign-In or Google Sign-In via Firebase Authentication. You are responsible for maintaining the security of your account. One account per person. Sharing account credentials with others is not permitted.

4. Subscription Terms

4.1 Plans and Pricing

• Monthly: €4.99 per month
• Annual: €34.99 per year (equivalent to ~€2.92/month)

Both plans include a 14-day free trial. Prices may vary by region based on App Store pricing tiers.

4.2 Billing

All subscriptions are billed through the Apple App Store. Apple's standard terms apply for billing, payment processing, and refunds. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period.

4.3 Managing Your Subscription

You can manage or cancel your subscription at any time in iOS Settings > [Your Name] > Subscriptions. Cancellation takes effect at the end of the current billing period — you retain access to premium features until then.

4.4 Free Tier

The free tier remains available without a subscription. It includes manual workout logging, the exercise catalog, rest timer, Performance Index scoring at the session level, personal record detection, and 7 days of session history.

5. Acceptable Use

You agree to use ProgressPilot only for personal, non-commercial fitness tracking purposes. You may not:

• Reverse engineer, decompile, or disassemble the app
• Scrape, abuse, or overload the AI service
• Attempt to circumvent subscription verification or premium feature gating
• Use the app or its AI-generated content for any unlawful purpose
• Share, redistribute, or commercially exploit AI-generated coaching content

6. Intellectual Property

The app, its design, exercise catalog, AI-generated content, and all associated materials are the property of the operator. You are granted a limited, non-exclusive, non-transferable license to use the app for personal fitness tracking.

Your data is yours. You retain full ownership of all workout data, training logs, and personal information you enter into the app. You can export your data via CSV export (premium feature) or delete it at any time.

7. AI-Generated Content Disclaimer

ProgressPilot's AI coaching is informational and educational in nature. It is not medical advice, personal training certification, or a substitute for professional guidance.

• AI-generated programs, targets, and advice are suggestions based on the data you provide
• The AI may occasionally produce inaccurate or suboptimal recommendations
• You are responsible for using your own judgment regarding exercise selection, weight selection, and workout intensity
• Consult a qualified healthcare professional before starting any exercise program, especially if you have injuries, medical conditions, or health concerns

8. Health Disclaimer

ProgressPilot is not a medical device and does not provide medical advice. The app's HealthKit integration is for convenience (saving workouts to Apple Health and reading cross-training data) and does not constitute health monitoring. Performance Index scores are performance metrics, not health indicators. Always consult a healthcare professional for medical concerns.

9. Data and Privacy

Your privacy is important to us. Please read our Privacy Policy for full details on how we handle your data. Key points:

• Your workout data is stored on your device and your iCloud account, not on our servers
• We do not collect analytics, serve ads, or track your behavior
• AI prompts contain training metrics only — no personally identifiable information

10. Service Availability

• AI features require an internet connection. All AI features have offline fallbacks that provide deterministic workout programming
• We do not guarantee 100% uptime for AI services. Our Cloudflare Worker proxy may occasionally be unavailable due to maintenance or upstream service issues
• We reserve the right to modify, update, or discontinue features with reasonable notice

11. Limitation of Liability

ProgressPilot is provided “as is” and “as available” without warranties of any kind, express or implied.

• We are not liable for any physical injury, health issues, or adverse outcomes resulting from following AI-generated exercise recommendations
• We are not liable for data loss, though we note that iCloud sync provides redundancy
• Our maximum aggregate liability is limited to the subscription fees you have paid in the 12 months preceding any claim

12. Termination

• By you: You can delete your account at any time from the app's Settings. This cancels your subscription and removes your data per our Privacy Policy
• By us: We may terminate or suspend your account if you violate these Terms. We will provide notice unless the violation requires immediate action

13. Governing Law

These Terms are governed by the laws of Finland. Any disputes arising from these Terms shall be resolved in the courts of Finland. If you are a consumer in the EU, you retain the right to bring claims in your country of residence per applicable EU consumer protection regulations.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via an in-app notice and update the effective date. Continued use of the app after changes constitutes acceptance of the updated Terms.
